NERC Hails Edo State’s New Electricity Litigation Framework

The Nigerian Electricity Regulatory Commission (NERC) has commended the Edo State Judiciary for adopting the Edo State High Court (Nigerian Electricity Supply Industry) Practice Directions, 2026, describing the development as a major step towards strengthening the legal and regulatory framework of the power sector.

The Practice Directions, introduced by the Edo State Judiciary under the leadership of the Chief Judge, Justice Daniel Iyobosa Okungbowa, came into effect on May 25, 2026. NERC said the move was the result of sustained engagements with state judiciaries aimed at addressing litigation challenges that have hindered the growth and efficiency of the Nigerian Electricity Supply Industry (NESI).

According to the Commission, the new Practice Directions provide for active case management and accelerated hearing of electricity-related disputes in Edo State, while mandating parties to explore Alternative Dispute Resolution (ADR) mechanisms before commencing court proceedings.

The guidelines also recognise electronic service of court processes through email and WhatsApp, streamline procedures for appeals arising from decisions of the Edo State Electricity Regulatory Commission, and establish a dedicated register for electricity market claims to be maintained by the court registrar.

NERC said the reforms are expected to enhance investor confidence, strengthen regulatory enforcement, and ensure the timely resolution of disputes within the Edo State electricity market.

The Commission noted that the adoption of the Practice Directions represents a significant milestone in efforts to create a more efficient, predictable and investor-friendly electricity sector in the state and the country at large.
